Welcome to MINDTHEGAP
These are the Terms and Conditions that apply when you shop with us at mindtheg.com. Please read them carefully before placing an order. By completing a purchase, you agree to be bound by these Terms.
These Terms are between you and MINDTHEGAP. “MINDTHEGAP”, “we”, “us”, and “our” refer to the MINDTHEGAP brand operated by MTG HOME COLLECTION LIMITED, a company registered in Ireland (Company No. 684162, VAT No. IE 3724330NH). “You” and “your” refer to the person placing an order as a consumer.
These Terms apply to consumer (B2C) purchases only. If you are purchasing in a professional or trade capacity, our separate Trade Terms & Conditions apply.
1. About MINDTHEGAP
MINDTHEGAP is a premium home furnishings and interior design brand, offering Wallpapers, Lighting, Fabrics, Cushions, Wall Art, Furniture, and Accessories.
Our consumer website, mindtheg.com, is owned and operated by MTG HOME COLLECTION LIMITED, a company registered in Ireland.

2. Your Agreement With Us
By placing an order on our website you agree to these Terms and Conditions. Our website is intended for customers aged 18 and over. If you are under 18, please do not submit personal information or place orders.
We may update these Terms from time to time. We will give you at least 14 days’ advance notice of any material changes before they take effect, either by email or by a prominent notice on our website. If you do not accept the changes you may cancel any outstanding orders placed before the change takes effect. Your continued use of our website or placement of new orders after the notice period constitutes acceptance of the updated Terms.
3. Product Characteristics & Suitability
MINDTHEGAP products are handcrafted with artistic intent, using natural materials. You may notice slight variations in colour, texture, or finish between individual products, samples, and website images. These are natural characteristics of premium artisanal production, not defects.
Colours shown on our website and in digital catalogues are as accurate as digital reproduction allows, but may vary depending on your screen calibration. Digital images are representative only and cannot replicate exact colour values.
Because wallpaper, fabric, and other printed materials are produced in batches, slight differences between dye lots may occur. Therefore, the consistency between samples and final production cannot be guaranteed. We strongly recommend that the full required quantity be ordered at once, as MINDTHEGAP cannot assure availability from the same batch for subsequent orders.
Samples are provided as an indicative reference only, and their age, exposure, or handling may alter appearance over time. Neither batch variations nor sample ageing constitute a defect.
Wallpaper
Wallpaper is printed to order in batches. Slight colour or dye-lot differences may occur between rolls from different production runs. Order all rolls at once to ensure batch consistency. Allow a 5% tolerance on pattern repeats.
Fabrics & Textiles
Natural fibres may show slight slubs, weave irregularities, and dye variations. A fibre content tolerance of 3% applies. These are characteristics of the material, not faults. Natural fabrics may fade in sunlight. We recommend using blinds or blackout lining. Do not treat fabric after purchase with flame-proofing or stain-repellent treatments, as this voids warranty coverage.
Velvet
Velvet pile may show impressions or shading during transit and normal use. This is a characteristic of the material, not a fault. Do not upholster velvet directly onto foam; use an appropriate interliner.
Leather
Leather products are made from natural hides and may show natural marks, tonal variations, and colour differences. These reflect the authenticity of the material and are not defects.
Suitability for Intended Use
You are responsible for verifying that any MINDTHEGAP product is suitable for your intended application before ordering and installing. If you are unsure, we recommend requesting a physical sample and consulting a qualified installer.
Please check the product specification on our website or contact us at [email protected] before purchasing if you have questions about suitability for a specific application.
Non-woven wallpaper must not be installed where it may be exposed to direct water contact or prolonged humidity.
Issues arising from incorrect specification or inappropriate use are not covered under warranty.
Measurements & Quantities
You are responsible for providing accurate measurements when ordering. Please calculate the quantity you need including allowances for pattern repeats and wastage. We cannot accept liability for overage or shortfall caused by incorrect measurements.
We strongly recommend ordering your full required quantity in a single order. We cannot guarantee that the same dye lot or batch will be available for a follow-up order, and any variation between batches does not constitute a defect.
4. Placing an Order
When you click “Place Order” at checkout you are making an offer to buy the products at the prices shown, including any delivery charges. A binding contract between you and MINDTHEGAP is formed only when we send you an official order confirmation by email.
We may decline your order if:
- A product is out of stock or unavailable
- We identify a pricing or product description error
- We cannot authorise your payment
- We have reasonable grounds to consider the order fraudulent or in breach of these Terms
If we cannot accept your order we will tell you as soon as possible, and provide a full refund if payment has already been taken.
Orders begin processing immediately upon confirmation, and changes cannot be guaranteed thereafter. Any modification requests, including product amendments, address changes, or additions, must be communicated as soon as possible at [email protected] and may not be accepted if production has already begun.
Discontinued or Modified Products
MINDTHEGAP reserves the right to update, modify, or discontinue products. If a product you have ordered is materially changed before dispatch, we will notify you and give you the option to accept the updated product, choose an alternative, or cancel for a full refund. Product discontinuation before your order is placed does not give rise to any claim.
5. Pricing & Payment
All prices shown on our website include VAT at the rate applicable in your country of residence, in accordance with the EU VAT e-commerce rules (the One-Stop-Shop scheme). We accept payment in EUR, GBP, and USD.
In the rare event of a pricing error we will contact you before proceeding and give you the option to confirm the order at the correct price or cancel for a full refund.
If you are ordering from outside the EU, you may be responsible for local import duties and taxes, determined by your country’s customs authority and not shown on our website.
Payment
We accept secure online payment via Stripe and PayPal. Payment is charged when you place your order. Your card issuer may carry out security checks; if payment cannot be authorised we will not be liable for any resulting delay or non-delivery.
All card and payment details are encrypted in transit. We do not store your full card information on our systems.
Payment Disputes
If you have a concern about a payment or charge, please contact us at [email protected] and seek to resolve the matter directly with us before raising it with your card issuer or payment provider. This does not affect your right to raise the matter with your card issuer or payment provider at any time, including through a chargeback.
6. Delivery & Risk
We ship globally, with delivery conditions varying by region and product type. Delivery costs are calculated based on the total weight and volume of your order and are displayed at checkout before you confirm your purchase.
Lead times depend on stock availability, production schedules, and logistical factors. Any lead time provided is an estimate only. While we make every effort to dispatch orders promptly, delays may occur due to production volume, courier limitations, customs procedures, or unforeseen circumstances. We will notify you as promptly as possible of any material delay. MINDTHEGAP is not liable for losses arising from delivery delays, including contractor rescheduling or installation delays.
We recommend that you do not book decorators, installers, or contractors until you have received and fully inspected all your goods.
When your order is dispatched you will receive a shipping confirmation email with a tracking link. For any delivery queries please contact us at [email protected].
Please ensure someone is available to receive and sign for your delivery. Check your goods carefully on arrival and report any visible transit damage to us within 48 hours.
Furniture & Oversized Items
Standard delivery for furniture and oversized items is kerbside unless a White Glove delivery service has been specifically requested, quoted, and approved in writing at an additional cost. Please ensure your delivery address provides adequate access via doors, corridors, lifts, and staircases.
Risk & Ownership
Risk of loss or damage passes to you when your goods are delivered to your address.
Ownership of the goods remains with MINDTHEGAP until full payment is received. Until ownership transfers, MINDTHEGAP may request the return of goods if payment remains outstanding.
Upon delivery, please verify immediately that all quantities, product codes, batch numbers, and colours match your order. Check all goods thoroughly before cutting, hanging, upholstering, or installing.
Once a product has been cut, altered, installed, or used, it can no longer be returned for a change of mind. This does not affect your right to claim under your statutory guarantee if a genuine manufacturing defect is later found (see Clause 8).
7. Installation & Storage
All products should be installed by qualified professionals with the appropriate skills and experience. This includes wallpaper hanging, fabric upholstery, furniture assembly, and electrical fitting of lighting.
Installers must inspect every product before cutting, hanging, upholstering, or assembling, including checking product codes, batch numbers, colour consistency, and pattern alignment. Cutting or installing a product constitutes acceptance of its condition at that point; no claim will be accepted for issues identifiable before installation.
Only industry-standard adhesives, pastes, fixings, and interliners should be used, in accordance with MINDTHEGAP’s care and installation guides. Damage arising from improper installation is not covered under our commercial warranty, though your statutory rights regarding pre-existing defects remain unaffected.
Do not book installers or contractors until you have received and fully inspected all your goods.
Storage Before Installation
Store all products in a clean, dry, climate-controlled environment, in their original packaging, away from direct sunlight, moisture, heat sources, and temperature extremes. Wallpaper and fabric must not be stored in basements, unheated spaces, or damp environments.
Damage caused by improper storage, including mould, warping, fading, or adhesive deterioration, is outside MINDTHEGAP’s liability and voids warranty coverage.
8. Warranty, Returns & Claims
Cancellation Before Dispatch
You may cancel your order at any time before it is dispatched by contacting us at [email protected]. We will issue a full refund.
For made-to-order products, please note that production may begin within 24 hours of order confirmation. We cannot guarantee cancellation after this window, even though the item has not yet been dispatched.
Your Right of Withdrawal: 14 Calendar Days
Under EU and Irish consumer law (EU Consumer Rights Directive 2011/83/EU), you have the right to cancel your order within 14 calendar days of receiving your goods, without giving a reason. To exercise this right, notify us clearly before the 14-calendar-day period expires using the contact details in Clause 1.
The following products are made to order and are non-returnable, except where confirmed as defective. You will be asked to confirm your understanding of this at the point of purchase before completing your order:
- Wallpaper (all custom lengths)
- Wall Art
- Lighting (shades)
- Furniture
- Fabric (cut to your specified length)
These exclusions apply under Article 16(c) of the EU Consumer Rights Directive.
Returning Standard (Non-Custom) Goods
Requests to return standard, unused goods must be submitted within 14 calendar days of delivery. The product must be in its original, unused condition and original packaging, and must not have been cut, altered, installed, or used in any way.
Return shipping costs for change-of-mind returns are your responsibility. We recommend using a tracked and insured courier service.
Refunds or credit notes for approved returns will be processed within 14 calendar days of our receiving the returned goods in satisfactory condition. Refunds will be issued to your original payment method unless you expressly agree otherwise.
Claims: Transit Damage
Claims for damage caused during transit must be reported to us within 48 hours of delivery, with photographic evidence and a written description. Claims submitted outside this timeframe may not be accepted.
Returning Faulty or Damaged Goods
Claims for manufacturing defects or quality issues must be submitted to [email protected] within 14 calendar days of delivery, with photographic evidence and a written description.
Do not carry out any work on the goods, including cutting, hanging, upholstering, or assembling, until we have assessed your claim. Work carried out before our inspection invalidates the claim.
If we confirm the goods are defective, we will arrange a replacement or full refund, whichever you prefer, and we will cover all reasonable return postage costs.
Goods must not be returned without our written authorisation. Please submit all claims to [email protected] first. Unauthorised returns will not be accepted or refunded.
Special Note on Wallpaper
Please inspect the entire roll before cutting or hanging. Once wallpaper has been cut or hung, we cannot accept responsibility for faults that could have been identified before installation, except in cases of latent defects not reasonably visible before installation. This does not affect your statutory rights regarding latent defects.
How to Initiate a Return
- Contact us at [email protected] and complete the return form.
- Our team will confirm whether the return is approved and provide the confirmed return address.
- Pack your goods securely and ship to the address we confirm in writing. Do not send goods to any other address.
- Upon receipt and inspection we will process your refund within 14 calendar days.
Your right to report a defect and claim a remedy under your statutory 2-year guarantee is not limited to 14 calendar days. The notification timeframes above are practical guidelines to help us investigate promptly; they do not restrict your statutory rights. See Your Statutory Guarantee, below, for your full statutory guarantee rights.
Your Statutory Guarantee
Under Irish law (Consumer Rights Act 2022) and the EU Sale of Goods Directive (2019/771), you have a statutory guarantee of at least 2 years from delivery for goods that are faulty, not fit for purpose, not as described, or not of the quality you would reasonably expect. If a fault appears within the first 12 months of delivery, it is presumed to have been present at the time of delivery, unless we can show otherwise. After the first 12 months, and up to the full 2-year guarantee, the same rights apply, though we may ask for more information to confirm the fault was present at delivery. Nothing in these Terms limits or removes these rights.
Our Commercial Warranty
MINDTHEGAP provides a commercial warranty of 12 months from delivery across all product categories, covering hidden manufacturing defects.
This commercial warranty is in addition to, and does not replace, your statutory rights.
What Is and Is Not a Defect
A manufacturing defect is a fault present in the product at the time of delivery. The following are not considered defects and are not covered under warranty:
- Normal wear and tear over time
- Fading or deterioration caused by exposure to sunlight, artificial light, or heat
- Natural variations in colour, texture, or finish inherent to handcrafted or natural-fibre products (see Clause 3)
- Damage caused by misuse, neglect, or accident
- Damage caused by improper installation, incorrect adhesives, or failure to follow our care and installation guides
- Damage caused by excessive humidity, water contact, or improper cleaning
- Chemical treatments applied after delivery, including flame-proofing or stain-repellent applications
- Damage caused by fire, flood, infestation, or other external events
- Products used in high-traffic commercial or contract environments unless expressly designated as suitable for contract use
- Damage resulting from improper storage prior to installation
9. Intellectual Property
All content produced by MINDTHEGAP, including designs, patterns, artworks, photography, text, graphics, and trademarks, is the exclusive intellectual property of MINDTHEGAP (or our licensors) and is protected by copyright and trade mark law.
You may view and download content from our website for your own personal, non-commercial use only. You may not copy, reproduce, modify, publish, distribute, or create derivative works from any website content without our prior written permission. Samples and products are supplied for personal use and reference only and may not be used to create derivative products for resale.
10. MINDTHEGAP’s Liability & Force Majeure
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot lawfully be excluded under Irish or EU consumer law, including your 2-year statutory guarantee rights
Subject to the above, our total liability in connection with any order will not exceed the price you paid for the products in that order. We are not liable for indirect or consequential losses such as loss of profit, loss of business, or project delays, except where caused by our negligence or a foreseeable breach of contract.
Your statutory rights as a consumer under Irish and EU consumer protection law are not affected by these Terms.
Force Majeure
MINDTHEGAP will not be liable for delays or failure to perform obligations caused by events beyond our reasonable control, including natural disasters, pandemics, war, civil unrest, government restrictions, supply chain disruptions, strikes, or transport interruptions.
We will notify you as soon as reasonably practicable of any force majeure event affecting your order. If a force majeure event prevents delivery for more than 30 days, either party may cancel the affected order without liability, and we will refund any amounts already paid for undelivered goods.
11. Privacy, Data & Cookies
MINDTHEGAP processes your personal data in accordance with GDPR and the Irish Data Protection Act 2018. Please read our full Privacy Policy at privacy-security for details of: what data we collect, the lawful basis for processing, how long we retain data, your rights as a data subject (access, rectification, erasure, portability, objection), and how to lodge a complaint with the Irish Data Protection Commission (www.dataprotection.ie).

12. Governing Law & Dispute Resolution
If a dispute arises, we will always try to resolve it amicably. Please contact us in the first instance at [email protected]. We aim to respond to all queries within 5 working days.
Escalation Procedure
Both parties agree to the following process before commencing legal proceedings:
- Step 1: Written notification to the other party, with 14 days to respond and seek agreement.
- Step 2: If unresolved, referral to an approved Alternative Dispute Resolution (ADR) body.
- Step 3: If still unresolved, either party may commence proceedings in the courts of the applicable jurisdiction.
Governing Law
These Terms are governed by Irish law. Where you are habitually resident in another EU member state, you retain the protection of any mandatory consumer-protection rules of that country (Rome I Regulation (EC) 593/2008, Article 6). Nothing in these Terms prevents you from exercising your rights under EU consumer protection law, including your right to bring proceedings in the courts of your country of habitual residence within the EU.
13. General Terms
Website Availability & Accuracy
We take reasonable steps to keep our website accurate and up to date, but cannot guarantee it will always be error-free or available. We may update or remove content at any time. We are not liable for losses caused by website downtime or inaccurate content, except where required by law.
General Provisions
If any part of these Terms is found unenforceable by a court, the remaining provisions continue in full force.
MINDTHEGAP may assign or transfer its rights and obligations under these Terms to a third party (for example, in a business sale or restructuring). We will give you at least 30 days’ notice of any such assignment and confirm that your rights will not be diminished. You may not assign your rights under these Terms without our prior written consent.
A failure by us to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
These Terms constitute the entire agreement between you and MINDTHEGAP and supersede any previous arrangements or understandings.
